Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until your web browser deletes them automatically.

If cookies are deactivated, the functionality of this website may be restricted.

If further cookies and services are used on this website, you can find information about this in this privacy policy.

In all other cases, processing is based on our legitimate interest in the effective processing of enquiries addressed to us pursuant to Art. 6 Abs. 1 lit. f DSGVO or on your consent pursuant to Art. 6 Abs. 1 lit. a DSGVO, where this has been requested. Consent can be withdrawn at any time.

The data you enter in the contact form remains with us until you request its deletion, withdraw your consent to storage or the purpose for data storage no longer applies, for example after your enquiry has been fully processed. Mandatory statutory provisions, in particular retention periods, remain unaffected.

Enquiry by Email, Telephone or Fax

If you contact us by email, telephone or fax, your enquiry, including all personal data resulting from it, such as name and enquiry, will be stored and processed by us for the purpose of handling your request. We do not disclose this data without your consent.

This data is processed on the basis of Art. 6 Abs. 1 lit. b DSGVO if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures.

The data transmitted to us by contact enquiries remains with us until you request its deletion, withdraw your consent to storage or the purpose for data storage no longer applies, for example after your request has been fully processed. Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

Registration on this Website

You can register on this website in order to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

For important changes, for example changes to the scope of the offer or technically necessary changes, we use the email address provided during registration to inform you in this way.

The data entered during registration is processed for the purpose of carrying out the user relationship established by the registration and, where applicable, for initiating further contracts pursuant to Art. 6 Abs. 1 lit. b DSGVO.

The data collected during registration is stored by us for as long as you are registered on this website and is then deleted. Statutory retention periods remain unaffected.

5. eCommerce, Credit Checks and Payment Providers

Processing of Customer and Contract Data

We collect, process and use personal customer and contract data for the establishment, content-related design and modification of our contractual relationships. We collect, process and use personal data relating to the use of this website, known as usage data, only to the extent necessary to enable the user to use the service or for billing purposes. The legal basis for this is Art. 6 Abs. 1 lit. b DSGVO.

The customer data collected will be deleted after completion of the order or termination of the business relationship and expiry of any existing statutory retention periods. Statutory retention periods remain unaffected.

Credit Check

Where we make advance performance for certain orders or contract conclusions, we reserve the right to carry out a credit check before dispatching the goods or before performing the contract. The purpose of the credit check is to assess the risk of payment default and to prevent fraud and payment defaults.

For this purpose, we transmit the personal data required for the credit check, for example name, address and, where applicable, further information required for identification, to a credit agency or a corresponding creditworthiness service provider. From there, we receive information about the probability of payment default and, where applicable, creditworthiness or score values.

Processing is carried out on the basis of Art. 6 Abs. 1 lit. f DSGVO. Our legitimate interest lies in economically protecting our company against payment defaults and in risk assessment before delivery on invoice or other advance performance.

Where the credit check is necessary for the decision on concluding or performing a contract, the processing may also be based on Art. 6 Abs. 1 lit. b DSGVO.

We use the following company to carry out credit checks:

Creditreform Bad Kreuznach Langenfeld KG
Rüdesheimer Straße 10
55545 Bad Kreuznach

The information obtained as part of the credit check is used exclusively for deciding on the establishment, performance or termination of the contractual relationship. Automated decision-making within the meaning of Art. 22 DSGVO does not take place.

6. Newsletter

We regularly inform interested parties and customers by email about news, products, services, promotions and other offers from our company.

Newsletters are sent either

on the basis of your express consent pursuant to Art. 6 Abs. 1 lit. a DSGVO in conjunction with § 7 Abs. 2 Nr. 3 UWG, or
within the scope of statutory existing-customer advertising pursuant to § 7 Abs. 3 UWG, provided that we have received your email address in connection with the sale of goods or services and you have not objected to the use of your email address for advertising purposes.

When you register for a newsletter, we process the data you provide, in particular your email address, for the purpose of sending the newsletter. Registration is generally carried out using the double opt-in procedure. After registration, a confirmation email is sent to verify the registration. In addition, the time of registration and confirmation is stored in order to be able to prove consent.

You may withdraw your consent at any time with effect for the future or object to the use of your email address for advertising purposes at any time. To do so, you can use the unsubscribe link in every newsletter or contact us at the following email address: datenschutzbeauftragter@allit.de.

7. Analytics Tools and Advertising

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited, “Google”, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, length of stay, operating systems used and origin of the user. This data is assigned to the respective user device. It is not assigned to a user ID.

Furthermore, we can use Google Analytics to record, among other things, your mouse and scroll movements and clicks. Google Analytics also uses various modelling approaches to supplement the collected data sets and uses machine learning technologies for data analysis.

Google Analytics uses technologies that enable recognition of the user for the purpose of analysing user behaviour, for example cookies or device fingerprinting. The information collected by Google about the use of this website is generally transferred to a Google server in the USA and stored there.

The use of this service is based on your consent pursuant to Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TDDDG. Consent can be withdrawn at any time.

Data transfer to the USA is based on the EU Commission’s Standard Contractual Clauses. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/.

The company is certified under the EU-US Data Privacy Framework, “DPF”. The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

IP Anonymisation

Google Analytics IP anonymisation is activated. This means that your IP address is shortened by Google within Member States of the European Union or in other contracting states to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services relating to website use and internet use to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser Plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

More information on how Google Analytics handles user data can be found in Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

8. Plugins and Tools

YouTube

This website embeds videos from the YouTube website. The operator of the website is Google Ireland Limited, “Google”, Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of our web pages on which YouTube is embedded, a connection is established to YouTube’s servers. In this process, the YouTube server is informed which of our pages you have visited.

Furthermore, YouTube may store various cookies on your device or use comparable technologies for recognition, for example device fingerprinting. In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness and prevent attempted fraud. In addition, the collected data is processed in the Google advertising network.

If you are logged into your YouTube account, you enable YouTube to directly assign your browsing behaviour to your personal profile. You can prevent this by logging out of your YouTube account.

YouTube is used in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 Abs. 1 lit. f DSGVO. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device, for example device fingerprinting, within the meaning of the TDDDG. Consent can be withdrawn at any time.

Further information on the handling of user data can be found in YouTube’s privacy policy at: https://policies.google.com/privacy?hl=de.

Google Maps

This site uses the map service Google Maps. The provider is Google Ireland Limited, “Google”, Gordon House, Barrow Street, Dublin 4, Ireland. With the help of this service, we can embed map material on our website.

To use the functions of Google Maps, it is necessary to store your IP address. This information is generally transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. If Google Maps is activated, Google may use Google Fonts for the purpose of uniform font display. When Google Maps is accessed, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

Google Maps is used in the interest of an appealing presentation of our online offers and easy findability of the locations indicated by us on the website.

Data transfer to the USA is based on the EU Commission’s Standard Contractual Clauses. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

More information on how user data is handled can be found in Google’s privacy policy: policies.google.com/privacy.

Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

9. Social Media Channels

We operate publicly accessible profiles on social networks for the presentation of our company and for communication with customers and interested parties, currently at:

  • Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, Facebook and Instagram
  • YouTube, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland
  • TikTok, TikTok Information Technologies UK Limited, WeWork, 125 Kingsway, London, WC2B 6NH, England, and TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland
  • LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland
  • Xing: New Work SE, Am Strandkai 1, 20457 Hamburg, Germany

In addition, our website uses buttons for the above-mentioned social networks. The buttons are marked with the logo of the respective social network. However, these are not the usual social plugins, but buttons with embedded links. The buttons must be activated separately by you by clicking on them. Only when you click the buttons and thereby declare your consent to communication with the servers of the social network do the buttons become active and the connection is established. You are then no longer on the page of the Allit Group of Companies.

By activating the button, the social networks then also receive information including that and when you accessed the corresponding page of our website, as well as, for example, your IP address, information about the browser used and language settings.

The legal basis for this data processing is your consent pursuant to § 25 Abs. 1 TDDDG and Art. 6 Abs. 1 S. 1 lit. a DSGVO.

Categories of Personal Data Processed through Our Social Media Presences

When you visit our social media presences, the following data relating to you is processed:

  • your username on the social network and comments published on our social media presences,
  • messages that you have sent to us via our social media presences,
  • your activity on our fan pages via the Facebook Insights and Instagram Insights services, including information about profiles visited, links clicked, date and time of interaction, and information about the countries and cities from which our visitors come,
  • other information necessary to answer enquiries from our visitors or to clearly identify our visitors in our systems.

Please note that we cannot trace all data processing purposes of the social media portals. Please refer to the privacy notices of the respective social media portals for information about further data processing purposes.

Purposes and Legal Basis of Processing

With our social media presence, we would like to offer you a broad range of multimedia services, comprehensively present our products to you and communicate with you. Data processing serves, in particular, the following purposes:

  • presentation of our company and corporate culture, including existing career and further training opportunities,
  • comprehensive product advice and answering customer and prospective customer enquiries,
  • communication with and information for visitors to the social media channels,
  • collection of statistical information about the reach of the social media channels,
  • conducting customer surveys, marketing campaigns, market analyses, prize draws, competitions or similar campaigns or events.

The legal basis for the purposes listed is our legitimate interest pursuant to Art. 6 Abs. 1 lit. f DSGVO. Our legitimate interest consists in presenting our company to you on the preferred channels and offering customers and interested parties an easy means of contact. In addition, we have a legitimate interest in analysing the reach and use of our social media channels in order to continuously adapt and optimise them for customers.

Joint Controllership for the Processing of Page Insights Data

We use the statistical information that is made available to us in anonymised form, including visits to our fan page, the extent of interactions, information about the countries and cities from which our visitors come, statistics on the gender distribution of our visitors, statistics on our visitors’ field of work and the average duration of video playbacks, in connection with the use of our social media presences via the services of the respective social media networks. It is not possible for us to draw conclusions about individual users.

According to the judgment of the Court of Justice of the European Union, CJEU, of 5 June 2018, the operator of social media pages is jointly responsible for data processing within the meaning of Art. 26 DSGVO, at least in the case of Facebook fan pages.

For this reason, we and the providers of the social network are considered “joint controllers” within the meaning of the DSGVO and have therefore concluded a so-called joint controllership agreement, insofar as the social networks offer such an agreement.

The individual joint controllership agreements can be found here:

Facebook Insights: https://www.facebook.com/legal/terms/page_controller_addendum

YouTube or Google and Xing currently do not provide an agreement on joint controllership. Further information on “YouTube Analytics” can be found at: https://support.google.com/youtube/topic/9257532?hl=de&ref_topic=9257610.

If you send us an application, we process the associated personal data, for example contact and communication data, application documents, notes taken during job interviews and similar data, to the extent necessary to decide on the establishment of an employment relationship.

The legal basis for this is § 26 BDSG, initiation of an employment relationship, Art. 6 Abs. 1 lit. b DSGVO, general contract initiation, and, where you have given consent, Art. 6 Abs. 1 lit. a DSGVO. Consent can be withdrawn at any time.

Your personal data is passed on within our company exclusively to persons involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 Abs. 1 lit. b DSGVO for the purpose of carrying out the employment relationship.

As part of the application process, we may, under certain circumstances, also carry out an internet search relating to your person. This primarily includes Google searches, LinkedIn and Xing. The legal basis for this type of processing is our legitimate interest pursuant to Art. 6 Abs. 1 lit. f DSGVO in obtaining an overall impression of publicly accessible information about you.

Retention Period of the Data

If we are unable to offer you a position, if you reject a job offer or if you withdraw your application, we reserve the right to retain the data you have transmitted to us on the basis of our legitimate interests pursuant to Art. 6 Abs. 1 lit. f DSGVO for up to six months from the end of the application process, rejection or withdrawal of the application. The data will then be deleted and the physical application documents destroyed.

Retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after expiry of the six-month period, for example due to a threatened or pending legal dispute, deletion will only take place once the purpose for further retention no longer applies.

Longer retention may also take place if you have given corresponding consent pursuant to Art. 6 Abs. 1 lit. a DSGVO or if statutory retention obligations prevent deletion.

11. Children and Young People

Persons under 18 years of age may not transmit any personal data to us without the consent of their parents or legal guardians. We do not request personal data from children or young people, do not collect such data and do not disclose it to third parties.
